This Legal Notice regulates the access and use of Dommuss. . Dommuss comprises both the internet portal http://www.dommuss.com and all its subdomains (hereinafter the Portal) and the mobile applications available in the Apple App Store – the App Store –
and in the Google App Store – Google Play –
(hereinafter, the Applications). Both the Portal and the Applications are the property of Dommuss, S.L., a Spanish company with tax identification number B87009817 registered in the Madrid Mercantile Register, Volume 32,242, folio 38, section 8, page M-580339, entry 1.

This Legal Notice includes the general conditions for browsing Dommuss and interacting with the Portal or the Applications in addition to the mandatory legal information required. The use or navigation by Dommuss attributes the condition of user (hereinafter, the "User") and implies acceptance of all the rules of use contained in this Legal Notice and the Privacy Policy. Therefore, it is advisable for the User to consult this Legal Notice frequently as it may vary. We also ask you to review our Privacy Policy.

1. Terms and Conditions of Use

You must make proper use of Dommuss in accordance with the law and this Legal Notice. Any breach of the law or this Legal Notice will void the permission or license granted by Dommuss to the user. In addition, the user shall be liable to Dommuss or to third parties for any damages that may be caused as a result of the breach of this obligation.

As a Dommuss User, you must refrain from:

1. Make unauthorized or fraudulent use of Dommuss and/or the contents for illegal purposes or effects, prohibited in this Legal Notice, damaging the rights and interests of Dommuss or third parties, or in any way may damage, disable, overburden, impair or impede the normal use of the services or documents, files and all kinds of content stored;
2. Reproduce, copy, sell, resell or exploit any of Dommuss's services or parts thereof for commercial purposes without our prior written consent.
3. Access or attempt to access resources or restricted areas of Dommuss, without fulfilling the conditions required for such access;
4. Damage to the physical or logical systems of Dommuss, its suppliers or third parties;
5. Introduce or spread computer viruses or any other physical or logical systems on the network that may cause damage to the physical or logical systems of Dommuss, its suppliers or third parties;
6. Attempt to access, use and/or manipulate the data of Dommuss, third party providers and other Users;
7. Delete, conceal or manipulate the notes on intellectual or industrial property rights and other data identifying the rights of Dommuss or third parties incorporated into the contents, as well as the technical protection devices or any information mechanisms that may be inserted in the contents;
8. Obtain and try to obtain the contents using means or procedures other than those which, depending on the case, have been made available for this purpose or have been expressly indicated or, in general, those which are commonly used on the Internet for not entailing a risk of damage or deactivation of Dommuss or its contents;
9. In particular, and for information purposes only and not as a limitation, the User undertakes not to transmit, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material that:


• a. In any way that is contrary to, disparages or violates the fundamental rights and public freedoms recognized in the Constitution, in international treaties and in other legislation;
• b. Induce, incite or promote criminal, denigrating, defamatory, violent or, in general, contrary to the law, morality, generally accepted good customs or public order;
• c. Induces, incites or promotes discriminatory actions, attitudes or thoughts based on sex, race, religion, beliefs, age or condition;
• d. Incorporate, make available or allow access to products, elements, messages and/or services that are criminal, violent, offensive, harmful, degrading or, in general, contrary to the law, morality and generally accepted good customs or public order;
• e. Induce or may induce an unacceptable state of anxiety or fear;
• f. Induce or incite to engage in practices that are dangerous, risky or harmful to health and mental equilibrium;
• g. It is contrary to honour, personal and family intimacy or to the image of the individual;
• h. Make up any kind of advertising;
• i. Include any type of virus or program not previously authorized expressly and in writing by Dommuss

 

2. Contents and intellectual and industrial property

All the contents of Dommuss, including but not limited to texts, photographs, graphics, images, icons, widgets, technology, software, links and other audiovisual or sound contents, as well as its graphic design and source codes (hereinafter, the "Contents"), which may be the subject of intellectual property, belong to Dommuss or to third parties with whom it has reached an agreement without any of the exploitation rights recognised by current legislation on intellectual property being transferred to the Users. In particular, Users must refrain from reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the Contents except in the cases authorized by law or expressly consented to by Dommuss.

Notwithstanding the foregoing, during the time that Users remain connected or surfing Dommuss may make use of such Content to the extent necessary for navigation and only as soon as such Content is accessible in accordance with the rules provided in this Legal Notice. Once the User disconnects from Dommuss, he will not retain any right of use over the previous Contents.

The graphics, logos, page headers, button icons, scripts and service names that are included in or available through the Dommuss services are either registered trademarks or represent the trade dress of Dommuss. The registered trademarks and the commercial image of Dommuss may not be used in relation to any product or service that does not belong to the Portal or the Applications, or in any way that is likely to cause confusion among users or that may undermine or discredit the same. There may be trademarks on the Portal or in the Applications belonging to third parties, who may or may not be related in any way to Dommuss, without this conferring any rights on the Users of such trademarks.

In addition, it is also not permitted to use framing techniques or "page framing" to introduce any trademark, logo or other information that may be protected by copyright (including images, text, page layouts or formats) of Dommuss without prior written consent. The use of meta tags or any other "hidden text" using the names or trademarks of the Site or the Applications without our prior written consent is also prohibited.

 

3. Conditions of registration

If, as a result of registration, you obtain a password as a User, you undertake to use it diligently and to keep it strictly confidential. The User is exclusively responsible for the correct custody and strict confidentiality of any passwords, access data or other elements provided by Dommuss, and undertakes not to transfer their use to third parties, neither temporarily nor permanently. The User shall be responsible for any unlawful use of the services by illegitimate third parties who use a password given to the User by Dommuss for this purpose. On the other hand, the identification and authentication by means of a User name and password make the User who possesses such User name and password, totally and only responsible for the acts that are carried out with and through this access to the services.

It is the User's inexcusable obligation to immediately notify Dommuss's managers of any fact that allows or may allow the misuse of the keys and/or passwords, including (but not limited to) theft, loss and other similar circumstances. As long as Dommuss is not informed of such facts, Dommuss shall be exempt from any liability arising from the misuse, fraudulent, mendacious or fraudulent use of such keys and passwords.

 

4. Exclusion of liability

Dommuss does not guarantee the availability or maintenance in the future of the services accessible through the Portal or the Applications and may decide at any time their interruption, suspension or definitive cancellation without any kind of compensation for the Users.

Dommuss does not guarantee continuous access, nor the correct viewing, downloading or use of the elements and information contained in the pages of Dommuss, which may be prevented, hindered or interrupted by factors or circumstances beyond its control.

Dommuss may interrupt the service or immediately terminate the relationship with the User if it detects an inappropriate use of its Portal, the Applications or that any of the services offered on it are being used contrary to this Legal Notice.

Dommuss makes available to Users an email address (info@dommuss.com) so that any content that may affect the activity of other users is displayed, with the will to rectify it if appropriate. The e-mail sent for this purpose must indicate in the subject line the reference "USER" containing in the body of the same the following data of the User: Name and Surname, ID number and contact telephone number. This data will be processed with the sole purpose of managing your request and will be incorporated into a file under the responsibility of Dommuss with the sole purpose of attending to your request. You may exercise your rights of access, rectification, cancellation and opposition in accordance with the Privacy Policy.

The Portal or the Applications may contain links to other pages. These pages, whose addresses are checked regularly, are not part of Dommuss. The Dommuss editorial team has no control over its content and declines all responsibility for the information presented there.

Furthermore, Dommuss shall not be liable for any damages, losses, claims or expenses incurred by:

1. Interference, interruptions, failures, omissions, telephone breakdowns, delays, blockages or disconnections in the operation of the electronic system, caused by deficiencies, overloads and errors in the telecommunications lines and networks, or any other cause beyond the control of Dommuss;
2. Illegitimate intrusions through the use of malicious programs of any kind and through any means of communication, such as computer viruses or any other;
3. Improper or inappropriate use of the Portal or the Applications;
4. Security or browsing errors caused by a malfunction of the browser or by the use of outdated versions of it. The administrators of Dommuss reserve the right to remove, in whole or in part, any content or information present on the Website;
5. Dommuss is not responsible for the lack of confidentiality of the information transmitted by third party telecommunications equipment and networks or for the software or hardware vulnerabilities of the Users' own equipment;
6. Dommuss is obliged to provide the competent bodies with all the information and collaboration necessary for the performance of their duties;

6. Modifications

7. Courts and Legislation

The parties, expressly waiving their own jurisdiction, accept the Spanish legislation governing this contract as the governing law and submit to the Courts and Tribunals of Madrid City for the resolution of any disputes that may arise from it.
